FilmFabriek attaches great importance to your privacy. We therefore process personal data carefully and securely. By doing this, we are complying with applicable privacy regulations. This privacy statement tells you how we do this. In addition, we set out your rights. We therefore recommend you read this privacy statement carefully.
We have the right to revise this privacy statement from time to time. We therefore recommend that you refer back to this privacy statement regularly, to ensure that you have the latest version. If we make major changes to our privacy statement, we will let you know about this on our website. This privacy statement was last revised in March, 2019.
Who is this privacy statement for?
This privacy statement applies to (potential) FilmFabriek customers and people who visit www.FilmFabriek.nl
Processing data
- in connection with orders and services
When you enter into an agreement with us we ask you to provide personal data. This mainly involves first and last name, company name, billing and mailing address, email address, telephone number, VAT number or business register number (commercial register if abroad) and IP address. This data is used to deliver service(s) (contract agreement) and to process orders. The data is stored on our own secure FilmFabriek servers, or those of a third party such as Ikoula. We will not combine this data with other personal data that we hold. We use your data exclusively for carrying out the agreement.
- for communications
When you send us emails, messages, documents, files or images, we may store them for the purposes of carrying out the order. Sometimes we ask you for your personal information relevant to the situation. This helps us answer your questions and/or process your inquiries. We will not combine this data with other personal data that we hold.
- after visiting our website
We use cookies on our website (small text files that are stored on your device/computer) to help the website analyze how visitors use the website. The cookies used often contain analytical information about the visit. You can check, delete and block cookies yourself at any time by changing the settings in your browser. More (general) information about how to change these settings can be found on the website aboutcookies.org. Changing these settings does not mean that you can no longer see any offers or advertising, but it may result in certain parts of the website functioning to a limited extent.
You are not legally obliged to provide us with your personal data. In other words, you are not legally obliged to share your personal data with us. However, when we enter into an agreement with you, we need certain personal information from you in order to carry it out. If you do not provide this personal information to us, we are simply unable to enter into an agreement with you and perform services for you. In order to use our website, we may also require certain personal data from you. If you do not provide this information, we cannot guarantee that our website will work properly.
Purpose for processing your data
We only process personal data obtained by us for the following purposes:
- We use your name and address, telephone number and email data from the contact inquiry to correspond with you and to send you quotes, invoices and other documents necessary for (carrying out) the agreement.
- If you provide us with your name, address, telephone number and email data via email, social media or our website, we use this to contact you.
- We may use your name and address details to send you promotional gifts from time to time, or to invite you to certain events.
Retention period
If we store your personal data, we do so for 12 months from the moment we receive the data. Unless we have entered into an agreement with you. In that case, we need your personal data for carrying out that agreement. We will then keep your personal data for a maximum of one year after completion of that agreement, unless there is a legal duty to keep it longer. This might include name and address data, contract, invoice and payment data, which we will keep for 7 years after the work has been completed.
Third parties
To the extent permitted by law and in accordance with privacy laws and regulations, we are entitled to share your personal data with other companies that assist us in carrying out our agreement with you (order processing) and that support us in the operation of our website and related processes, or in the context of legitimate interest.
We do not allow these third parties to use your personal data for any other purposes. Also, we do not sell your data to any third parties. We are also entitled to use or share your personal data to the extent that this is legally permitted or that is necessary in connection with legal proceedings that have been instigated or are yet to be instigated.
This privacy statement does not apply to third party websites or services that connect to our website through links or social media buttons. We cannot guarantee that these third parties will handle your data in a reliable and secure manner. We advise you to read the privacy statement for these third parties before using their website or services.
We use the following service providers, among others: web analysis services, payment services and delivery services etc.
In order to carry out the agreement, it may even be necessary that we pass some of your details on to our service providers abroad, such as our reseller FilmFabriek USA (Big Pic Media LLC, 8037 Gabriels Bend Drive, Raleigh, NC, 27612, USA). In that case we would ask for your consent. We have order processing agreements in place with these parties, as sufficient guarantee for the lawful transfer of data, and, insofar as required, have used standard data protection provisions with our order processors, in accordance with Article 46, paragraph 2, section (c) of the Dutch data protection regulations (AVG).
Google Analytics
We use Google Analytics from the company Google in the U.S. to keep track of statistics on the use of our website. For this purpose, Google places analytical cookies in your browser and displays the anonymized information to us, so that we obtain insight into how our visitors use the website. Google may provide this information to third parties if Google is legally required to do so, or insofar as third parties process the information on Google’s behalf. By participating in the Privacy-Shield framework, Google provides an appropriate level of protection. Google may therefore not use the information obtained for other Google services or purposes. We have also disabled forwarding IP addresses to Google via Google Analytics.
Stg. Mollie Payments
We use Stg. Mollie Payments to provide payment services, who accept the following payment methods: credit card, bank card, PayPal, iDeal etc.
We provide the following information to Mollie Payments for processing payments: Order number, first and last name, payment method and information about the order.
Mollie Payments is responsible for further processing your personal data via the relevant payment service providers. For more information about their data protection, please visit https://www.mollie.com/nl/privacy.
Your rights
How to make an inquiry
For inquiries about our privacy statement, or questions regarding access and changes to (or deletion of) your personal data, you can contact us at any time by email or letter.
Right to inspect and correct
You have the right to inspect the personal data that we process about you at any time. On request, we can send you a summary of the personal data about you that we have processed. You have the right to have us correct any inaccuracies in the personal data that we process about you. If you believe that the personal data is incomplete for the purpose for which it is being processed, you can make it complete by sending us a statement to that effect.
Right to be forgotten
You have the right to request us to delete any personal data that we process about you. If requested, we will comply with this as soon as possible.
Right to restrict processing of personal data
You also have the right to request us to restrict processing your personal data, instead of deleting it. This means that we will not use the personal data, or only partly, whilst this restriction applies. You have this right of restriction if:
- You dispute the accuracy of the personal data that we are processing and we are checking its accuracy;
- Processing your personal data is unlawful, but you do not want us to delete the personal data;
- We no longer need your personal data, but you do need it as part of legal proceedings;
- You have objected to us processing your personal data and we are investigating whether our
interests in processing it outweigh your interests in the event of objection.If processing is restricted, we will only process such personal data for which we have your consent or that is necessary for legal proceedings. Also, we will not restrict processing if it is needed for the rights of others, or for other important reasons. We will let you know when the restriction is lifted.
Right to data portability
You may wish to transfer the personal data that we process about you to another party. We will carry out your request on demand. In this event, you can choose whether to transfer the data to you, or directly to that other party.
Right of objection
You have the right to object to us processing your personal data. In the event of an objection, we will cease the processing except where we have compelling justified grounds for continuing to process your personal data and those grounds outweigh your interests. We may also have reason not to cease the processing, as part of legal proceedings.
Withdrawing consent for data processing
You have the right to withdraw your consent to us processing your personal data at any time. We will stop processing your personal data at your request. Please note: withdrawing consent has no retroactive effect.
Automated decision making
We do not use automated decision making which could affect your statutory rights or affect you in any other way.
Complaining to the Dutch data protection authority
If you are unhappy with the way we process your personal data, you can of course contact us. We will try to work it out together.
